Red States Build Legal Case Against LNG Pause (E&E News)
Pamela King, Carlos Anchondo, and Brian Dabbs (Feb. 7): 23 Republican-led states are preparing legal claims against President Biden’s pause on USLNG export permits. They argue that the pause threatens billions in capital expenditures and tens of thousands of jobs. The states accuse the administration of succumbing to the pressure of climate activists, thereby harming the economy and jeopardizing national security. They invoke the “major questions” doctrine, arguing that the Natural Gas Act requires the DOE to approve USLNG export applications unless they are explicitly not in the public interest. The states challenge the administration to provide clear information that proves additional USLNG export capacity would harm Americans.  Link to Content
